Terms & conditions

Welcome to Owl Aby. These Terms & Conditions ("Terms") are the agreement between you and Owl Aby, Inc. ("Owl Aby," "we," "our"), a Delaware corporation, about how you may use our mobile app, website, and related services (together, the "Service"). By creating an account, starting a trial, or using any part of the Service, you agree to these Terms. If you don't agree, please don't use the Service.

We've tried to write these in plain English. Where a section starts with "In short:", that's a summary — it isn't a replacement for the legal language but should help you find what you need.

1. Agreement & acceptance

In short: Using Owl Aby means you agree to these Terms.

These Terms form a binding legal agreement between you and Owl Aby. Together with our Privacy Policy and any platform-specific terms (Apple App Store), they govern your use of the Service. If you're using Owl Aby on behalf of an organization (e.g., a childcare service or school), you represent that you have authority to bind that organization, and "you" includes that entity.

2. Your account & eligibility

In short: Accounts are for adults. You're responsible for keeping yours secure.

2.1 Who can create an account

Owl Aby accounts are for parents, legal guardians, and other adult caregivers. You must be at least 18 years old (or the age of majority in your jurisdiction, whichever is higher) to create an account. The Service is designed for adults to use on behalf of a child.

2.2 Account information

You agree to provide accurate, current information when creating your account and to keep it updated. You're responsible for safeguarding your login credentials and for any activity that happens under your account. If you believe your account has been accessed without authorization, contact us immediately through our contact page (use the subject "Security disclosure").

2.3 One account per family

Each Owl Aby account is intended for one household. You can invite up to four caregivers to share access to a child's profile (see Section 5). Sharing your account credentials with people outside your household is not permitted.

3. Subscriptions, trials & billing

In short: Free for 7 days. Then $39.99/year or $7.99/month. Cancel anytime.

3.1 Plans

Owl Aby is a paid subscription service. New users receive a 7-day free trial of full access; after the trial, an active paid subscription is required to generate new stories. Plans are Annual at $39.99/year or Monthly at $7.99/month (prices in USD; equivalent pricing applies in other currencies as set by the App Store). Plan details are on our pricing page. Stories created during an active subscription remain accessible in your library after cancellation; only new generation requires an active subscription.

3.2 Free trial

New Premium subscribers receive a 7-day free trial. During the trial you have full access to Premium features. No charge is made at sign-up. We will send a reminder email on day 5 of the trial. If you don't cancel before day 7, your selected plan will renew automatically and your payment method will be charged. Apple may have its own trial policies; in case of conflict, the platform's terms apply to your purchase.

3.3 Auto-renewal

Subscriptions automatically renew at the end of each billing period (monthly or annual) unless you cancel at least 24 hours before the renewal date. You can turn off auto-renewal at any time in your App Store or Owl Aby account settings.

3.4 Price changes

We may change subscription prices from time to time. If we do, we'll notify you by email at least 30 days before the change takes effect for your account, and the new price applies only to the next renewal — never retroactively.

4. Cancellation & refunds

In short: Cancel any time, keep your library, get a refund in your first 30 days if it isn't right.

4.1 How to cancel

You can cancel a paid subscription at any time:

  • In the Owl Aby app: Profile → Subscription → Manage / Cancel
  • iOS: Settings → [your name] → Subscriptions → Owl Aby → Cancel

When you cancel, you keep Premium until the end of the current billing period. After that, the ability to generate new stories pauses, but your library, profiles, and saved stories remain in your account and stay readable / downloadable. Restart your subscription at any time to resume new story generation.

4.2 Refunds

If you're within 30 days of your first paid charge (i.e., your first month of paid Premium after the trial), reach out via our contact page and we'll refund that charge. After that, charges are generally non-refundable except where required by law.

Subscriptions purchased through the App Store are also subject to that platform's refund policy. We can't issue refunds for those purchases directly — you'll need to request through Apple.

4.3 What happens to your data when you cancel

Cancelling a subscription does not delete your account or content. To fully delete your account and data, go to Profile → Account → Delete Account. After confirmation, your data enters a 30-day grace period (in case of accidental deletion) and is then permanently erased. See the Privacy Policy for details.

5. Children's use & parental consent

In short: Parents own the account. Children listen to stories — they don't create profiles or sign in.

5.1 Children do not have accounts

Owl Aby is designed so that only the parent or guardian holds an account. Children listen to and interact with stories the parent has set up. The Service does not knowingly enable a child under 13 (in the US) or under 16 (in the EU/UK) to register, log in, or independently provide personal information.

5.2 Child profile information

When you create a child profile, you may provide their first name (or a nickname), age in months/years, interests, and favorite animal/color. This information is used solely to personalize the Service for that child. You can edit or delete a child profile at any time. We treat all child profile data in accordance with the Children's Privacy section of our Privacy Policy and applicable law (including COPPA in the US and GDPR-K in the EU).

5.3 Sharing access with other caregivers

You can invite up to four additional caregivers per child (e.g., the other parent, grandparents, a nanny) with read-only or parent-level permissions. You are responsible for ensuring that anyone you invite is a trusted adult and is authorized to access information about your child.

5.4 Parental supervision

Owl Aby is intended to be used with your child, not as unsupervised entertainment for very young children. While we filter content carefully, AI-generated stories can occasionally produce unexpected text or imagery, and we recommend a parent be present, especially for children under 5.

6. Your content & the license you give us

In short: You own what you create. We need a small license to actually run the app.

6.1 You retain ownership

Anything you create or upload through Owl Aby — child profiles, voice recordings, custom prompts, highlights, notes, family content ("Your Content") — remains yours.

6.2 License you give us

To operate the Service, you grant us a worldwide, royalty-free, non-exclusive license to host, store, reproduce, display, modify (e.g., resize or transcode), and transmit Your Content solely as necessary to provide the Service to you. This license ends when you delete the content (or your account), except for backup copies which we erase within a reasonable period not to exceed 90 days, and except where we are legally required to retain it longer.

6.3 We do not use Your Content to train AI

We do not use Your Content — including child profiles, voice recordings, generated stories, or prompts — to train, fine-tune, or evaluate any artificial intelligence model, whether ours or a third party's. This is a commitment we hold beyond what most app terms require.

7. AI-generated stories & content

In short: AI helps write the stories. We filter carefully, but it's not perfect — please don't rely on it for medical or safety advice.

7.1 How stories are made

Owl Aby uses large language models and image generation models, accessed through trusted providers (see our sub-processor list). Stories are generated based on your child's profile and the theme you select, then passed through multiple safety filters before being shown.

7.2 No guarantee of perfection

AI-generated content may occasionally include factual errors, unexpected phrasing, or content that doesn't quite fit your family's values. We provide an in-app "report this story" button, and we review every report. If you encounter content that feels inappropriate for your child, please tap report and (optionally) let us know via the contact page.

7.3 Not medical, legal, or therapeutic advice

Owl Aby's advice content — tips, behavior explainers, and routines — is informed by pediatric research and reviewed by qualified advisors. It is not medical, psychological, or legal advice and is not a substitute for consultation with a pediatrician, mental health professional, or other qualified specialist. If something concerns you about your child's development, please consult your pediatrician.

8. Acceptable use

In short: Use Owl Aby the way it's meant to be used — for your own family, kindly.

You agree not to:

  • Use the Service for any purpose other than personal, family use (no commercial broadcasting, classroom mass-use without a separate agreement, etc.)
  • Create content intended to harm, harass, or sexualize any person, especially minors
  • Attempt to bypass content filters, safety guardrails, or technical restrictions
  • Reverse-engineer, decompile, or attempt to extract source code, models, or training data
  • Resell, sublicense, or commercially exploit any part of the Service
  • Use automated means (scrapers, bots) to access or copy content
  • Upload malicious code, viruses, or material that infringes third-party rights
  • Impersonate another person or misrepresent your relationship to the child whose profile you create

Violations may result in suspension or termination of your account, as described in Section 14.

9. Intellectual property

In short: The app, brand, and original content are ours. Your stuff is yours.

9.1 Our property

The Owl Aby name, logo, app, website, design system, original illustrations, voice models, and software ("Owl Aby IP") are owned by Owl Aby, Inc. and protected by copyright, trademark, and other intellectual property laws. Nothing in these Terms transfers any of that ownership to you.

9.2 Limited personal license

Subject to your compliance with these Terms, we grant you a limited, personal, non-transferable, non-exclusive, revocable license to use the Service for non-commercial personal and family use.

9.3 Feedback

If you send us feedback, suggestions, or ideas, we may use them without obligation to you. We're always happy to hear from parents — and we may build what you ask for.

10. Third-party services & app stores

Owl Aby is distributed through the Apple App Store, which has its own terms that also apply to your installation and use of the app. If there's a conflict between these Terms and the platform terms with respect to your purchase, the platform's terms govern that purchase. We may also use third-party services (e.g., cloud hosting, AI providers, email delivery, analytics) to operate the Service; see the Privacy Policy for a current list.

11. Disclaimer of warranties

The Service is provided "as is" and "as available." To the fullest extent permitted by law, Owl Aby disclaims all warranties, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranties arising from course of dealing or usage of trade. We do not warrant that the Service will be uninterrupted, timely, secure, or error-free, or that any AI-generated content will be accurate, complete, or suitable for every child.

Some jurisdictions don't allow the exclusion of certain warranties. In those jurisdictions, the exclusions above apply only to the maximum extent permitted by law.

12. Limitation of liability

To the maximum extent permitted by law, Owl Aby, its affiliates, and its directors, officers, employees, contractors, and agents shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages — including loss of profits, data, goodwill, or other intangible losses — arising out of or in connection with your use of (or inability to use) the Service.

Our total cumulative liability arising out of or related to these Terms or the Service, regardless of cause of action, shall not exceed the greater of (a) the amount you paid us for the Service in the 12 months preceding the event giving rise to the claim, or (b) $100 USD.

Nothing in this section limits liability that cannot lawfully be limited (for example, liability for gross negligence, fraud, willful misconduct, or death/personal injury caused by negligence where applicable law does not allow that limitation).

13. Indemnification

You agree to indemnify and hold harmless Owl Aby, Inc. and its officers, directors, employees, and agents from any claims, damages, liabilities, costs, or expenses (including reasonable attorneys' fees) arising out of (a) your breach of these Terms, (b) your misuse of the Service, or (c) your violation of any law or third-party right. We'll notify you promptly of any such claim and may, at our option, assume control of its defense.

14. Suspension & termination

14.1 By you

You may stop using the Service at any time. To cancel a paid subscription, see Section 4. To fully delete your account, go to Profile → Account → Delete Account.

14.2 By us

We may suspend or terminate your access to the Service, with or without notice, if you (a) materially violate these Terms; (b) use the Service in a way that puts other users, children, or our infrastructure at risk; (c) we're required to do so by law; or (d) we discontinue the Service entirely.

14.3 Effect of termination

Upon termination, your right to use the Service ends. Sections that by their nature should survive — including ownership, licenses granted to us for retained content, disclaimers, liability limits, indemnification, and dispute resolution — will survive.

15. Governing law, disputes & arbitration

These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-laws principles. Except for claims that may be brought in small-claims court, you and Owl Aby agree that disputes arising from or relating to these Terms or the Service will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. The arbitration will take place in Wilmington, Delaware (or, at your election, by video where reasonable). You and Owl Aby waive the right to a jury trial and to bring or participate in any class action.

If applicable law in your jurisdiction does not permit individual arbitration of a particular claim, the arbitration clause does not apply to that claim, but the rest of the dispute-resolution provisions remain in effect. EU/UK consumers retain all rights to seek resolution through their local courts where mandatory.

Right to opt out of arbitration. You can opt out of the arbitration clause within 30 days of creating your account by sending a written request through our contact page with the subject "Arbitration Opt-Out" and your account email. Opting out won't affect any other part of these Terms.

16. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we'll notify you by email (using the address associated with your account) and post the new version with an updated "Last updated" date at least 30 days before the changes take effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms. If you don't agree to the changes, you can cancel your subscription and delete your account before they take effect.
